Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Mubyn platform operated by C. Monkey Tribe SARL ("we," "us," or "our"). By accessing or using Mubyn at mubyn.com or app.mubyn.com, you agree to be bound by these Terms.

2. Description of Service

Mubyn is an AI-powered business operating system for SMEs. The platform includes AI-driven lead generation, marketing analytics, financial intelligence, customer support, content creation, and website building — all managed by Caesar, our AI COO.

3. Accounts

  • You must be at least 16 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete registration information
  • One person or entity per account (no shared accounts)
  • You are responsible for all activity that occurs under your account

4. Subscription Plans

4.1 Plans

  • Founding Member ($29/month): All modules, up to 200 leads/month, priority support — limited to the first 100 spots
  • Starter ($99/month): Core modules, up to 50 leads/month, email support
  • Pro ($199/month): All modules, up to 200 leads/month, priority support, advanced analytics
  • Enterprise ($499/month): Custom integrations, dedicated support, multi-location, SLA

4.2 Billing

  • Subscriptions are billed monthly in advance
  • All fees are non-refundable except as required by law or as provided in our Refund Policy for the early-access credit
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension after a 7-day grace period

5. Acceptable Use

You agree NOT to:

  • Use Mubyn for any illegal or unauthorized purpose
  • Send spam, unsolicited messages, or bulk automated communications through Mubyn
  • Attempt to reverse engineer, decompile, or disassemble the platform
  • Interfere with or disrupt the platform's infrastructure
  • Upload malicious code, viruses, or harmful content
  • Impersonate another person or entity
  • Exceed rate limits or abuse API endpoints
  • Use the platform to compete directly with Mubyn
  • Resell or redistribute access to the platform without authorization

6. Intellectual Property

6.1 Our Property

The Mubyn platform, including its design, code, AI models, features, and branding, is owned by Mubyn. You may not copy, modify, or distribute any part of the platform.

6.2 Your Data

You retain full ownership of all business data you upload or generate through Mubyn. You grant us a limited license to process your data solely to provide the service. This license terminates when you delete your account.

6.3 AI-Generated Content

Content generated by Caesar (AI-written posts, emails, website copy, financial analyses) is provided for your use. You own the output generated for your business. We do not claim ownership of AI-generated content created for your account.

7. Third-Party Integrations

When you connect third-party services (Shopify, Meta, Google, WhatsApp), you are also subject to their respective terms of service. We are not responsible for third-party service availability, data accuracy, or policy changes.

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may perform maintenance with reasonable advance notice
  • We are not liable for downtime caused by third-party services or force majeure

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUBYN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.

Our total liability for any claim arising from your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Mubyn, its officers, employees, and agents from any claims, losses, or damages (including reasonable legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

  • You may cancel your account at any time from Settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be retained for 30 days, then permanently deleted
  • Sections on liability, indemnification, and intellectual property survive termination

12. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable commercial arbitration rules.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
